News has been circulating throughout the media that the Union Government has taken back the legal protection that it had provided to the authorities of Twitter because they are not complying with the new IT norms. The Union government has stated that it has lost its status as an intermediary platform due to non-compliance with Information Technology rules. If any kind of unlawful content is now published on Twitter, legal action will be taken not against the person, but against the its authorities that allow it.

Twitter’s Rocky Relation With The Indian Government

Twitter has already been a part of many face-offs with the Indian government. Many political updates which are of relevance have been posted on Twitter when the major media houses failed to show them. Recently, there has been a case of a 70-year-old Muslim man in Ghaziabad who had been attacked. Twitter has often called out BJP to be manipulating the media. This had happened during the farmers’ protests as well. Most of these reactions have generated sharp rebukes from the government.

Can The Legal Status Be Revoked?

It has been noted by the experts that the legal position of Twitter is not something that the Indian government can take away. It is for the Internet Freedom Federation to decide whether it can still exist as an intermediary body or not. This quality of social media sites is not assigned by any government but rather a technical qualification. This has been mentioned clearly under the IT act.

Twitter is protected under Section 79 of the IT Act which states that the intermediary body cannot be held liable for any kind of third-party information. Intermediaries are not liable to any kind of penalty if they take down the content which has been challenged by the legal bodies of a country.
