Five women petitioned to worship Hindu idols which they claimed to be on the outer wall of the Gyanvapi mosque (It is situated near the Kashi Vishwanath temple). As a result, a Varanasi court ordered the survey of the mosque complex. The Anjuman Intezamia Masjid Committee has questioned the maintainability of the case as they claim that it violates the Places of Worship Act, 1991.

The act prohibits the conversion of any place of worship and provides for the maintenance of the religious character of the place of worship as it existed on 15th August, 1947. In Gyanvapi Mosque case history, this act is the major hope of the defendants.

After the survey, the Hindus said that a ‘Shivling’ had been allegedly discovered in the mosque compound while the Muslims said that it was merely a fountain. The supreme court ordered the sealing of the pond after the claim that a shivling had been found.

The Muslims were not happy with this decision as they couldn’t do their purification ritual known as ‘Wazoo’ and that in turn affected their way of praying.

The Hearing Of The Gyanvapi Mosque

The hearing as to the maintainability of the case began on May 26, 2022. A lawyer of the petitioners (Hindus), Madan Mohan Yadav, had claimed that  Gyanvapi Mosque had been built on a portion of the Kashi Vishwanath temple. While, the defence (Muslims) states that the mosque had been on the site from the beginning.

The Varanasi district judge, Ajay Krishna Vishvesha decided to provide the verdict on September 12, after hearing the arguments of both sides (the Hindus and the Muslims).

Recent Events Regarding The Gyanvapi Mosque Case

The advocate of the Hindus said that they will demand Carbon dating next if the verdict as to the maintainability of the case is in their favour.

The security had been increased and Section 144 has been imposed in Varanasi a day ahead of the verdict of the district court. The police conducted a flag march in Lucknow ahead of the verdict to create a sense of security among the people.

The Verdict

The verdict has been declared in favour of the Hindus and the lawsuit has been deemed maintainable. The next hearing of the case will be on September 22.
